5 militia men must stay locked up awaiting trial

DETROIT — A federal appeals court says five members of a Michigan-based militia will stay in jail while awaiting trial on charges including conspiracy to overthrow the government.

The court said Tuesday that no conditions of their release would guarantee the safety of the community. Two judges on the three-judge panel reversed the decision of a federal judge in Detroit.

The five have remained in custody while prosecutors appealed the ruling of U.S. District Judge Victoria Roberts. They are David Stone and Joshua Stone of Lenawee County, Mich., Michael Meeks of Manchester, Mich., Thomas Piatek of Whiting, Ind., and Joshua Clough (CLUFF) of Blissfield, Mich.

Four other Hutaree members were sent home in May with electronic monitors.
